Kgathi presents ICC domestication bill

Minister of Defence, Justice and Security says given the  country’s support  towards the International Criminal Court, it is important that Botswana domesticates the Rome Stature of the International Criminal Court.

Presenting a bill in Parliament for the second reading, Mr Shaw Kgathi said the object of the Rome Statute of the International Criminal Court, Bill No. 21 of 2016 was to provide for the domestication of the Rome Statute of the International Criminal court which was ratified by Botswana in September 2000.

Mr Kgathi said by ratifying the Rome Statute, Botswana became one of the 60 countries that contributed to the entry into force of the statute.

He noted that the Rome Statute provided for the prosecution of core international crimes which were genocide, crimes against humanity and war crimes.

“It also provides for the cooperation of states with the International Criminal Court (ICC) whose seat is at The Hague, Netherlands,” he said.

Mr Kgathi said Botswana, as a state party to the Rome Stature, would enact the law, conform to and implement her obligations as set out under the Rome Stature.

He said one of the principal obligations was for Botswana to domesticate the stature by legislation so that it could have direct effect in its national laws.

“State parties to the Rome Stature hold annual meetings called Assembly of State Parties (ASP), where they exchange views on the operations of the court. His Excellency the President of the Republic of Botswana was the second head of state to attend the meeting of ASP, thereby raising the importance of the annual meetings of the ASP,” he said.

Mr Kgathi further said Botswana was one of the active supporters of the court, and that it had cooperated with the court in executing its mandate as set out in the Rome Stature.

He said Botswana demonstrated her commitment to the Rome Stature by hosting the meetings of the Kampala amendments to the Rome Stature and the regional seminar on fostering cooperation with the ICC in Gaborone on April 15 2013 and October 29 2015 respectively. BOPA
